SUMMARY:Maxwell Lectures: Impartiality and the Construction of Trust in Investor State Dispute Settlement
DESCRIPTION:Event Details\nMaxwell Lectures: Impartiality and the Construction of Trust in Investor State Dispute Settlement | 30 April 2024\nThis year\, we had the privilege of hosting Professor Stavros Brekoulakis\, the Michael and Laura Hwang Chair of International Arbitration at the National University of Singapore to deliver the 2024 Maxwell Lecture on the topic “Impartiality and the Construction of Trust in Investor State Dispute Settlement”. \nThe Lecture called for a new\, and contextualised\, understanding of impartiality which aligns more closely with the value of trust in ISDS. Drawing findings from a large-scale empirical project\, Professor Brekoulakis challenged the applicability of an orthodox judicial idea of impartiality in ISDS. The lecture also highlighted that a judicial doctrine of impartiality does not reconcile with the fundamental value of trust in ISDS arbitrators which is constructed on a fundamentally different basis from that of trust in national and international judges. \nIf you have missed the live session\, you can now watch the recorded session below \n\nQ&A from the Lecture:\nQ1: What are the potential challenges in the future for issuing arbitral awards? Are there any changes in environment or technology that may mitigate or worsen these challenges? \nQ2: What aspects of arbitration are ready for AI? \nQ3: What do you think are the key issues that need to be considered when using technology? \nQ4: About diversity\, I notice that the ICC now has an almost 50/50 male/female mix. Is this too fast and too artificial? \nQ5: For operating with ICC arbitration\, since the publishing of the ICC arbitration rules 2021 in the year of 2021\, which part of the arbitration rules 2021 would ICC suggest multi-national companies\, future expert witnesses\, future party representatives and future arbitrators to pay attention to as per ICC’s observation so far? \nQ6: What would ICC like expert witnesses\, party representatives\, and arbitrators to do (and prepare themselves) in order to operate ICC arbitration in line with ICC’s vision? \nWatch the full recorded session below:\n\n\n30 April 2024\n5.00pm – 6.30pm (GMT+8)\n\n\nSingapore\nOrganiser: Maxwell Chambers\nFormat: Hybrid (In-person at Maxwell Chambers\, Online over Zoom)\n\n \n\n\n \n\n\nCategory\nFee (SGD)\n\n\n\n\n\nYouTube Livestreaming Ticket\nFree\n\n\nZoom Webinar Ticket\n$30*\n\n\n\nAttendance Policy\nParticipants who wish to obtain CPD Points are reminded that they must comply strictly with the Attendance Policy set out in the CPD Guidelines. SUMMARY:Maxwell Chambers - Greensquare: Textile Donation Drive\, a #MaxwellGoesGreen initiative
DESCRIPTION:Event Details\nLet’s Recycle – Give your clothes and household textiles a second life\nDid you know that an estimated 95% of all clothing\, shoes\, and other fabrics can be recycled in a textile recycling operation?  \nMake an impact for Earth Day 2024. The collection point will be at Maxwell Chambers Suites from 17 April to 23 April 2024. \nBased on statistics shared by the National Environment Agency\, Singapore generated more than 254\,000 tonnes of textile and leather waste\, but only 2% of such waste was recycled in 2022. In comparism\, 6% of such waste was recycled in 2016 and 4% in 2021. \nLet us do our part to keep textiles in a closed recycling loop to help: \n\nconserve natural resources (E.g. it takes 6\,813 litres/1\,800 gallons of water to grow enough cotton to make just one pair of jeans)\nreduce environmental pollution (as we reduce the waste going to the incineration plant and landfill)\nfacilitate economical pricing for clothes and foot wear (for use in developing countries)\n\nWhat can you donate?\n\n\n \n\n\nWILL ACCEPT\nDO NOT PUT\n\n\n\n\n\nTextiles that are Clean\, Dry and in usable condition\nItems that are Wet\, Mouldy\, Stained or Torn\n\n\n\n\nClean clothes\nClean and wearable paired shoes\nClean bedsheets\nClean towels\nClean curtains\, cushion covers\nBelts (usable condition)\nTote Bags (usable condition)\n\n\n\n\nBooks\nToys\, Soft Toys\nStationaries\nPillows\, Bolsters\, Cushions\nUndergarments\nUsed Socks\nBreakable items\n\n\n\n\n\nPacking tips: Please arrange the clean clothes and textiles into bags and tie them so that there will not be any contamination.\nQ&A from the Lecture:\nQ1: What are the potential challenges in the future for issuing arbitral awards? Is this too fast and too artificial? \nQ5: For operating with ICC arbitration\, since the publishing of the ICC arbitration rules 2021 in the year of 2021\, which part of the arbitration rules 2021 would ICC suggest multi-national companies\, future expert witnesses\, future party representatives and future arbitrators to pay attention to as per ICC’s observation so far? \nQ6: What would ICC like expert witnesses\, party representatives\, and arbitrators to do (and prepare themselves) in order to operate ICC arbitration in line with ICC’s vision? \nWatch the full recorded session below:\n\nDonation Drive Details\n\n17 April – 23 April 2024\n9:00am – 5:30pm\n\n\n#01-04 Maxwell Chambers Suites (please refer to the map below)\n\n\n \nWhat happens next to the collected textiles?\n \nOur Partner\n\nAbout Greensquare\nGreensquare has been providing textile recycling service to households and organisations in Singapore\, and collected over 100 tonnes of textiles in 2022. \nMission\nGreensquare aspires to make a positive impact; our current target is to double the percentage of recycled textiles from 7% to 14% by 2030. We aim to provide free textile recycling services to households and organisations in Singapore and promote awareness of the 3Rs (Reduce\, Reuse\, Recycle) through education\, with a focus on engaging youths in schools. \nInstagram: @greensquare.sg \nWebsite: www.greensquare.com.sg \n\nFind out more about #MaxwellGoesGreen initiative

SUMMARY:Beyond the Black Box: Six Degrees of Separation - Independence\, Impartiality\, and Duty of Disclosure
DESCRIPTION:Event Details\nBeyond the Black Box: Six Degrees of Separation – Independence\, Impartiality\, and Duty of Disclosure | 12 October 2023\nThere have been significant cases recently which considered the issues of bias and conflicts of interest in international arbitration. The need to ensure that justice is not only done but is also seen to be done in arbitration to resolve their disputes. What should an arbitrator disclose and what should the arbitrator do if being challenged by one of the parties. Are we being too sensitive or being too practical? \nFor our second session\, join our facilitators\, Delphine Ho and Jern-Fei Ng KC as they lead the discussion and explore the various types of conflicts of interest\, and instances where a challenge based on conflicts crosses the line and becomes and abusive one. \nThe discussion\, subject to the Chatham House Rules\, will address\, amongst others: \n\nHow much uniformity exists among the various sets of institutional rules and guidelines\nWhat are the main types of conflict of interest that pose a challenge in arbitration proceedings\nHow much independence and impartiality do users seek\nWhat are users expecting\, and to what extent do expectations differ concerning the users’ own arbitrator\, the arbitrator appointed by the opponent\, and the chairperson\nIn what ways can party-appointed arbitrators impact independence and impartiality\nWhen and why should an arbitrator be challenged\nWhether the approach to disclosure and challenges should be revisited\n\nRegistration for the event has closed.  \n\n12 October 2023\n6.00pm – 7.30pm (GMT+8)\nRegistration starts at 5.50pm.
