DESCRIPTION:This seminar seeks to explain why and in what circumstances an unjust enrichment claim is available where the defendant received the enrichment in discharge of a legal obligation. Answers to these questions help us to understand the relationship between unjust enrichment and neighbouring areas of law. It also examines the justification for restitutionary awards for failure of condition and considers when\, given this justification\, such awards should be made.

DESCRIPTION:In this seminar\, Professor Onyema will explore the development of the “office” of the international arbitrator into an identifiable profession and\, drawing from some of the arbitrator (and award) challenges\, share some thoughts on whether it is now time for the international arbitration community to recognise and accept this independent role of the professional arbitrator in the context of arbitrator liability for professional misconduct\, and the implications of such recognition for the community.
