Beyond the Black Box: When Experts Disagree: What Are They Really Disagreeing About?

Expert disagreement is not always a disagreement of opinion. Experts may reach different conclusions because of different instructions, assumptions, data or methodologies or because they genuinely differ in professional judgment.

This roundtable asks whether the arbitral process does enough, early enough, to identify the real source of that disagreement, and whether doing so could help tribunals and parties determine the most appropriate procedural response.

Who should attend?

Experts and dispute resolution practitioners who work with expert evidence and are interested in sharing practical perspectives on how disagreements between experts arise, how they are managed, and where the arbitral process could do better..

To ensure a meaningful and interactive session, attendance will be capped. Register your interest early – confirmed participants will receive a confirmation email no later than 1 November.

The number of participants will be limited to ensure the invitees have an opportunity participate in the discussion. Successful registrants will be notified by email as soon as possible.

Facilitators

Amanda Lees, Partner, Mallesons

Amanda is a cross border dispute resolution specialist based in our Singapore office. She assists her clients to resolve disputes through international arbitration, litigation and mediation. Amanda is an expert in international arbitration in the Asia Pacific region, including in Malaysia, Indonesia, Vietnam, Myanmar, India, China, Hong Kong, Singapore and Australia. Amanda has significant experience in both commercial and investment treaty arbitration. She also acts as international counsel in complex cross border litigation. Amanda is quick to grasp complex and technical disputes across a range of industry sectors, including energy and resources, commodities, construction, finance, insurance, telecommunications, technology, manufacturing and consumer goods. Amanda takes a strategic approach to dispute resolution that keeps her client’s commercial objectives at the fore. Signifying Amanda’s expertise and reputation in the field, she is regularly appointed as arbitrator and is on the arbitrator panels of leading arbitral institutions. She is a director of the Singapore branch of the Chartered Institute of Arbitrators and has taught arbitration procedure and law to hundreds of lawyers across the Asia Pacific. Amanda is also a regular speaker at international conferences. Amanda is the Head of Mallesons' Singapore Dispute Resolution practice, and Head of Mallesons' International Arbitration practice in Australia and Singapore.

Michael Tonkin, Partner, HKA

Michael Tonkin is a Chartered Quantity Surveyor, Chartered Arbitrator, RICS Accredited Expert Witness and CEDR Accredited Mediator with over 35 years of construction industry experience. He is an effective dispute resolver and has acted as quantum expert on around 80 occasions. Michael has been a party appointed expert witness, a single joint expert witness and a third-party expert evaluator. He has given oral testimony in traditional cross-examination as well as concurrent evidence (hot-tubbing) in international arbitrations, in Asia, Australasia and the Middle East. Michael often acts as ‘coordinating expert’ across several disciplines of expert. Michael has been appointed as arbitrator on more than 70 occasions (as sole arbitrator, chairman of a tribunal of three, and co-arbitrator) under the auspices of ICC, LCIA, DIAC, ADCCAC and the TAI. He regularly participates in other alternative dispute resolution processes such as adjudication and dispute adjudication boards (DABs).

Cassandra Anthonisz

Deputy Manager of Legal & Business Service

Cassandra Gayle Anthonisz is the Deputy Manager of Legal and Business Services at Maxwell Chambers. Her multifaceted experience spans across legal, business development, and communications sectors, offering a distinctive combination of legal acumen, strategic insight, and cross-sector versatility.

Her professional background encompasses legal affairs, compliance, business development, and legal technology. She has held in-house positions across sectors, where she gained extensive experience navigating complex legal and regulatory environments. Her experience spans the implementation of strategic legal frameworks in sectors such as maritime, commodities, and fintech, with a focus on client-facing legal operations; contractual negotiations; contentious and non-contentious work.

Prior to joining Maxwell Chambers, Cassandra led legal technology start-ups through the unprecedented challenges of the Covid-19 pandemic. In these capacities, she integrated legal innovation with corporate strategy, while spearheading business development initiatives and cross-border legal solutions.

Cassandra has a passion for advancing access to justice and to promoting forward-thinking and progressive business-aligned legal practices. She holds a Bachelor of Laws (LLB) from Birmingham City University in the United Kingdom, and is currently pursuing a Master of Laws (LLM).

Ban Jiun Ean

CHIEF EXECUTIVE

Ban Jiun Ean read law at the National University of Singapore before joining the Ministry of Law. He spent nine years doing legal policy work, with a focus on the development of Singapore’s alternative dispute resolution (ADR) industry. 

Jiun Ean spearheaded the development of the world’s first integrated dispute resolution centre, Maxwell Chambers, which brought together arbitral institutions, service providers and legal practitioners under the same roof in a facility equipped with bespoke dispute resolution rooms and state-of-the-art supporting technology. In 2010, he was appointed Chief Executive of Maxwell Chambers, helming the company for five years and establishing it as the foremost dispute resolution centre of its kind in the world. In 2016, he left Maxwell to pursue several other projects, including the development of an arts centre and to write several novels. In 2019, Jiun Ean was appointed as the Executive Director of Singapore Mediation Centre (SMC), working to strengthen the mediation industry in Singapore and globally. 

Jiun Ean returns to Maxwell Chambers as Chief Executive, to augment the team as it continues to build on Maxwell’s position as the premier ADR facility in the world.
