In the fourth session of Maxwell Conversations on 12 July 2022, we discussed the topic “Duties of International Arbitrators”. The webinar was attended by more than 600 participants from over 70 countries.

The panelists included Prof Bernard Hanotiau of Hanotiau & van den Berg, Elodie Dulac, Partner at King & Spalding, and Byung-Chol (B.C.) Yoon, Partner at Kim & Chang. The discussion was moderated by Lawrence Teh, Global Co-Head of International Arbitration of Dentons, who was hosting the webinar in person at Maxwell Chambers.

Speakers

PROF BERNARD HANOTIAU

Bernard Hanotiau is a member of the Brussels and Paris Bars, since 1976 and 1989 respectively. In 2001, he established a boutique law firm in Brussels concentrating on international arbitration and litigation. The firm has offices in Brussels and Singapore.

Since 1978, Bernard has been actively involved in international commercial arbitration as party-appointed arbitrator, chairman, sole arbitrator, counsel and expert in various parts of the world.

He is the author of Complex Arbitrations: Multi-party, Multi-contract & Multi-issue, Kluwer, The Hague, 2006, second edition 2020 and of more than 120 articles, most of them relating to international commercial law and arbitration, and he frequently lectures on this topic.

LAWRENCE TEH

Lawrence Teh is the Global Co-Head of Dentons’ International Arbitration practice and a senior partner in Dentons Rodyk’s Litigation and Dispute Resolution practice group. He is Co-Head of Dentons Rodyk’s International Arbitration and Shipping practice groups. He has particular experience in handling commercial disputes including those of international trade and commodities, maritime and aviation, banking and financial services, onshore and offshore construction, mergers, acquisitions, joint ventures and other investments, and insurance.

Lawrence advises clients and acts as counsel and appears regularly as lead counsel in the Singapore courts, in arbitration, mediation and other forms of dispute resolution. He is a fellow of the Chartered Institute of Arbitrators (CIArb), a fellow of the Singapore Institute of Arbitrators (SIArb) and is appointed regularly as an arbitrator in international disputes under rules and auspices of international arbitration institutions like the ICC, SIAC, HKIAC, SCMA, KCAB, AIAC, SHIAC and THAC.

He is member of the Nominations Committee of the International Bar Association (IBA), the Administrator of the Comité Maritime International (CMI) and a Master of the Bench (Overseas) of the Honourable Society of the Inner Temple.

He is named in numerous legal guides and directories including the The Legal 500 Asia Pacific, International Who’s Who for Commercial Litigation, International Who’s Who of Shipping & Maritime and Asialaw Leading Lawyers for Shipping, Maritime & Aviation and in the Guide to the World’s Leading Aviation Lawyers.

ELODIE DULAC

Elodie Dulac is a partner in King & Spalding international arbitration group in Singapore, where she has been based for over 15 years. She specialises in international commercial arbitration, investment treaty arbitration and public international law. Elodie has particular expertise in energy, mining, joint venture/shareholder disputes as well as disputes involving States and Asia-Africa disputes. In addition to her work as counsel, Elodie has been appointed as arbitrator in over 20 arbitrations, including under the auspices of the ICC, HKIAC, SIAC, AIAC, KIAC and ad hoc. She is admitted to practice in England & Wales (Solicitor-Advocate) and Paris, France. She is also a Registered Foreign Lawyer at the Singapore International Commercial Court.

BYUNG-CHOL (B.C.) YOON

Byung-Chol (B.C.) Yoon is a partner at Kim & Chang and the co-chair of the firm’s International Arbitration Practice.

Mr. Yoon has represented the firm’s clients in more than 200 arbitration cases arising out of complex multi-jurisdictional disputes of wide ranging subject matters, including mergers and acquisitions, joint ventures, overseas investments, construction, and others. He is a member of the LCIA Court and has previously served on the ICC International Court of Arbitration and the SIAC Board of Directors. He is lauded as one of Korea’s foremost arbitration experts, having served as President of the Korean Council for International Arbitration (KOCIA) and played a key role in promoting international arbitration in Korea and revising KCAB’s International Arbitration Rules.

Mr. Yoon has been consistently ranked as a leading practitioner by Chambers Global, Chambers Asia-Pacific, Legal 500, and The International Who’s Who of Commercial Arbitration. Mr. Yoon was one of ALB’s 2021 Asia Super 50 Dispute Lawyers based on client recommendations.
