Maxwell Conversations: Party Representation and Equal Treatment

Maxwell Conversations features leading personalities at the top of the international dispute resolution industry. These events seek to challenge assumptions with a deeper examination of the issues.

In the fifth session of Maxwell Conversations on 5 April 2023, we discussed the topic “Party Representation and Equal Treatment”. The webinar was attended by more than 1000 participants.

The panelists included prominent arbitrator Prof. Gabrielle Kaufmann-KohlerProf. Dr. Mohamed Abdel Wahab, Founding Partner & Head of International Arbitration at Zulficar & Partners, and Yoshimi Ohara, Partner at Nagashima Ohno & Tsunematsu. The discussion was moderated by Lawrence Teh, Global Co-Head of International Arbitration of Dentons, who was hosting the webinar in person at Maxwell Chambers.

Speakers

PROF. GABRIELLE KAUFMANN-KOHLER

Gabrielle Kaufmann-Kohler practices international commercial, investment and sports arbitration. She is regularly ranked among the top arbitrators worldwide; a study of investment arbitration released in 2016 concluded that she was the “most influential arbitrator in the world”. Gabrielle is also a Professor at Geneva University Law School and the founder of the Geneva LLM in International Dispute Settlement (MIDS), a joint program of the Graduate Institute of International and Development Studies and Geneva Law School. She is also the President of the Center for International Dispute Settlement (CIDS). She teaches international arbitration law and heads a number of research projects in this area.

Among other positions, Gabrielle is President of ICCA since April 2018. She is also Honorary President of the Swiss Arbitration Association (ASA) and was ASA President from 2001 to 2005. She is further a founder of the FIAA and the President of its Advisory Board, and a former member of the ICC Court, LCIA Court, and AAA Board. She was and is a member of the Swiss delegation to UNCITRAL Working Group II on transparency, and to Working Group III on the reform of investor-state arbitration, for which she co-authored two CIDS reports.

LAWRENCE TEH

Lawrence Teh is the Global Co-Head of Dentons’ International Arbitration practice and a senior partner in Dentons Rodyk’s Litigation and Dispute Resolution practice group. He is Co-Head of Dentons Rodyk’s International Arbitration and Shipping practice groups. He has particular experience in handling commercial disputes including those of international trade and commodities, maritime and aviation, banking and financial services, onshore and offshore construction, mergers, acquisitions, joint ventures and other investments, and insurance.

Lawrence advises clients and acts as counsel and appears regularly as lead counsel in the Singapore courts, in arbitration, mediation and other forms of dispute resolution. He is a fellow of the Chartered Institute of Arbitrators (CIArb), a fellow of the Singapore Institute of Arbitrators (SIArb) and is appointed regularly as an arbitrator in international disputes under rules and auspices of international arbitration institutions like the ICC, SIAC, HKIAC, SCMA, KCAB, AIAC, SHIAC and THAC.

He is member of the Nominations Committee of the International Bar Association (IBA), the Administrator of the Comité Maritime International (CMI) and a Master of the Bench (Overseas) of the Honourable Society of the Inner Temple.

He is named in numerous legal guides and directories including the The Legal 500 Asia Pacific, International Who’s Who for Commercial Litigation, International Who’s Who of Shipping & Maritime and Asialaw Leading Lawyers for Shipping, Maritime & Aviation and in the Guide to the World’s Leading Aviation Lawyers.

PROF. DR. MOHAMED ABDEL WAHAB, C.ARB, FCIARB

Founding Partner & Head of International Arbitration, Construction and Energy, Zulficar & Partners, Egypt; Professor of International Arbitration, Private International Law and English Contract Law, Cairo University; ICCA Treasurer & Member of the Governing Board; Vice-Chair of the ICC Governing Body for Dispute Resolution Services; Vice President Global of the CIArb; President Elect of the CIArb (2025); Dean of the Africa Arbitration Academy; Chair of the International Expert Committee of the Permanent Forum for China Construction Law; Co- Chair, IBA Arab Regional Forum; Vice-Chair of the Advisory Committee of the CRCICA; Member of the Advisory Board of the MIAC; Member of the LACIAC Court of Arbitration; Member of the ITA Academic Council; Member of the Court, PCA, and Member of the Board of Trustees of the CIArb.

He served as ‘Arbitrator’, ‘Legal Expert’ and ‘Counsel’ in more than 250 cases, involving parties from the Africa, Asia, Canada, Europe, the Middle East and the United States. His expertise in cross border multi-jurisdictional and highly complex transactions and disputes is extensive and broad.

YOSHIMI OHARA

Ms. Ohara is a Partner at Nagashima Ohno & Tsunematsu. Her practice focuses on international arbitration, litigation and mediation. She served as counsel in international arbitration under the rules of the ICC, ICSID, AAA/ICDR, SIAC and JCAA. She also served as co-arbitrator, sole arbitrator and chair arbitrator under rules of the ICC, SIAC, JCAA, KCAB, ICDR and UNCITRAL. She is a governing board member of ICCA, a board member of Swiss Arbitration Association (ASA) and an executive director of the Japan Association of Arbitrators (JAA). She is a former Vice President of LCIA Court and the ICC Court. She is listed as a member of the ICSID panel of arbitrators.

Cassandra Anthonisz

Deputy Manager of Legal & Business Service

Cassandra Gayle Anthonisz is the Deputy Manager of Legal and Business Services at Maxwell Chambers. Her multifaceted experience spans across legal, business development, and communications sectors, offering a distinctive combination of legal acumen, strategic insight, and cross-sector versatility.

Her professional background encompasses legal affairs, compliance, business development, and legal technology. She has held in-house positions across sectors, where she gained extensive experience navigating complex legal and regulatory environments. Her experience spans the implementation of strategic legal frameworks in sectors such as maritime, commodities, and fintech, with a focus on client-facing legal operations; contractual negotiations; contentious and non-contentious work.

Prior to joining Maxwell Chambers, Cassandra led legal technology start-ups through the unprecedented challenges of the Covid-19 pandemic. In these capacities, she integrated legal innovation with corporate strategy, while spearheading business development initiatives and cross-border legal solutions.

Cassandra has a passion for advancing access to justice and to promoting forward-thinking and progressive business-aligned legal practices. She holds a Bachelor of Laws (LLB) from Birmingham City University in the United Kingdom, and is currently pursuing a Master of Laws (LLM).

Ban Jiun Ean

CHIEF EXECUTIVE

Ban Jiun Ean read law at the National University of Singapore before joining the Ministry of Law. He spent nine years doing legal policy work, with a focus on the development of Singapore’s alternative dispute resolution (ADR) industry. 

Jiun Ean spearheaded the development of the world’s first integrated dispute resolution centre, Maxwell Chambers, which brought together arbitral institutions, service providers and legal practitioners under the same roof in a facility equipped with bespoke dispute resolution rooms and state-of-the-art supporting technology. In 2010, he was appointed Chief Executive of Maxwell Chambers, helming the company for five years and establishing it as the foremost dispute resolution centre of its kind in the world. In 2016, he left Maxwell to pursue several other projects, including the development of an arts centre and to write several novels. In 2019, Jiun Ean was appointed as the Executive Director of Singapore Mediation Centre (SMC), working to strengthen the mediation industry in Singapore and globally. 

Jiun Ean returns to Maxwell Chambers as Chief Executive, to augment the team as it continues to build on Maxwell’s position as the premier ADR facility in the world.
