Insolvency proceedings and arbitration agreements often collide – forcing difficult choices for in-house counsel, creditors, and boards. Should a winding-up petition proceed, or must it pause while parties arbitrate? How do Malaysian and international courts reconcile the collective nature of insolvency with the contractual promise to arbitrate? In this presentation, Professor Nadja Alexander examines international mediation developments since the coming into force of the Singapore Convention on Mediation in 2020. Drawing on the trends identified in the SIDRA Survey on International Dispute Resolution, she explores the increasing and differentiated use of mediation in mixed mode procedures, how technology is challenging conventional understandings of mediation, and corresponding shifts in international mediation law and practice.

The Herbert Smith Freehills Kramer – SMU Asian Arbitration Lecture Series was established in 2010 and made possible by a term fund contribution by Herbert Smith Freehills Kramer. The objective of the Lecture Series is to promote collaborative forms of dispute resolution and access to justice, and in so doing to promote Singapore as the centre for dispute resolution in Asia, particularly in arbitration and mediation.
